Guernsey retains its EU adequacy – as expected

The post-Brexit regulatory landscape continues to throw up challenges and jurisdictional arbitrage, but there are some areas where consistency and stability are welcome. The recent confirmation from the European Commission that 11 jurisdictions had retained their “adequacy” status from a data protection perspective has left many breathing a (long anticipated) sigh of relief. Guide to companies in the Isle of Man

The Isle of Man has two separate company law regimes: one establishing companies governed by the Companies Acts 1931-2004 (1931 Act) and the other the Companies Act 2006 (2006 Act) (together, Manx Companies). The 1931 Act is based on a traditional company law regime familiar to English company lawyers. The 2006 Act follows the international business company model which is available in a number of offshore jurisdictions which is less formal and devolves a number of administrative matters to a registered agent rather than a public registrar.

In a significant move to safeguard the privacy and security of its citizens' personal information, Seychelles introduced the new Data Protection Act, 2023 (DPA) in December 2023, which is now in force. The DPA repeals the Data Protection Act 2003 which was enacted but never implemented in practice.
