Appleby acts for a fintech company’s subsidiary on its unprecedented motion before the Supreme Court of Mauritius

The application was filed before the Bankruptcy Division of the Supreme Court wherein Appleby successfully invoked the Court’s exercise of its power under section 263 of the Companies Act 2001 to issue additional orders pursuant to a previously approved amalgamation scheme as far back as 2016.
The application was in line with the group’s project of restructuring and sought to complete the amalgamation process which had previously been approved by the Court but remained incomplete.
The issue of the additional multi-million worth order involved a completed amalgamation scheme which was the final puzzle to the jigsaw.
