Bio

Jae is an Associate in the Dispute Resolution department in Appleby’s Cayman Islands office and an attorney with substantial experience acting for and advising high-profile individual and corporate clients across a wide range of commercial disputes and litigation. Jae’s experience spans insolvency disputes as well as claims in relation to directors’ duties and regulatory investigations, as well as advising on litigation risks for various corporate clients involved in major mergers and acquisitions.

Prior to practising in the Cayman Islands, Jae held roles as a Tipstaff (a role analogous to a judicial clerk) to a Judge of the Supreme Court of New South Wales and as a Lawyer in the Disputes & Investigations team of Gilbert + Tobin in Sydney. Jae was previously admitted as a solicitor in Australia and is qualified to practise in that jurisdiction.

Jae is a native speaker of Korean and is also fluent in Japanese.

Work Highlights

Recent cases and matters include:

  • Advising a party linked to a major ongoing liquidation in Hong Kong of a major development company incorporated in the Cayman Islands, which has involved providing advice as to the liquidators’ claims against the company’s former executives and related parties as a matter of Cayman Islands law (mainly concerning common law recipient liability in proprietary claims and unjust enrichment claims).
  • Advising a major United States financial services company in circumstances where winding up proceedings had commenced in the Cayman Islands despite a receivership process already having been commenced in the United States by the Federal Deposit Insurance Corporation. This has involved advising on Cayman Islands law on conflicts of laws, the relationship between “main” and “ancillary” liquidations as well as general principles applying to the determination by Cayman Islands courts in applications relating to winding up processes.
  • Advising Dart Enterprises, a major Caymanian developer, in a dispute with hospitality service providers, including on matters of Cayman Islands law relating to contractual construction and interpretation, related tortious liability and choice of laws.
  • Advising Binance, a major cryptocurrency service provider, in relation to criminal proceedings in the Cayman Islands concerning proceeds of crime held in accounts on the Binance platform in circumstances where Binance was simultaneously co-operating with governmental authorities in the United States in relation to the recovery of such proceeds.
  • Advising limited partners in an exempted limited partnership registered in the Cayman Islands in relation to relief for the removal and replacement of a recalcitrant general partner.
  • Acting for a listed mining investment company in defending proceedings brought by liquidators of subsidiaries involved in an unsuccessful joint venture, alleging insolvent trading and breaches of directors’ duties.*
  • Acting for a major Australian airline in defending proceedings commenced by investors alleging breaches of corporate disclosure laws.*
  • Advising a large Australian bank in relation to multiple investigations by Australian corporate regulators examining retail practices in the banking sector.*
  • Analyses of litigation risks for due diligence processes in relation to numerous major corporate mergers and acquisitions in Australia.*

Qualifications & Education

Jae was admitted to the Cayman Islands Bar as an Attorney-at-Law in September 2024. He was previously admitted as a solicitor in the Supreme Court of New South Wales in July 2019 and in the Federal Court of Australia and the High Court of Australia in October 2019.

Jae obtained a combined Bachelor of Arts/Bachelor of Laws degree from the University of Sydney. Jae majored in Japanese Studies and minored in French Studies for his Arts degree.
