Our lawyers have a wide range of expertise, enabling us to provide clear, sound and timely advice on the full spectrum of contentious and non-contentious insolvencies and restructurings. The team advises companies, their directors and advisors, on issues ranging from winding-up of a company to developing schemes of arrangement to enable the company to refinance. Examples of the group’s concentration of expertise include:
- Representation for insolvency work and related fraud, asset recovery and constructive trust proceedings
- Handling major insolvency and restructuring matters
- Handling complex and often ground-breaking liquidations, schemes of arrangement and corporate rescues. Working closely with forensic accountants to achieve the best possible return to creditors or shareholders
- Liquidation of all types of companies and partnerships, both on conventional insolvency grounds and as a consequence of governmental or regulatory action in the 'public interest’
- Acting for liquidators, provisional liquidators and other office-holders as well as regularly representing creditors, shareholders and directors in relation to the appointment and removal of such office-holders and claims brought by or against them
- Advising on creditors' rights and schemes of arrangement
- Advising on both solvent and insolvent restructuring
- Insolvency proceedings relating to mutual funds and hedge funds
- Cross-border issues, such as the co-ordination of proceedings with Chapter 11 proceedings in the US and the recognition of liquidators and receivers appointed in other jurisdictions
Among the high-profile cases we have recently handled are the restructuring of FLAG Telecom Group and Global Crossing Group in Bermuda. Cayman matters have included the proceedings arising out of the collapse of Enron, the winding up of some 60 companies connected with the US based Cash4Titles fraudulent investment scheme and continuing proceedings in the liquidation of BCCI, the world's largest-ever insolvency.
